    Original Debt (eg. Credit card/Loan/Overdraft) : Payday Loan
    Particulars of Claim: Please type out in full excluding names/account numbers:
    Asset Collections and Investigation claim this amount in respect of an unpaid loan by The Lending Stream. The defendant failed to abide by the terms of the contract. ACI purchased this debt from the lending stream and subsequently sent a notice of assignment to the defendant to advise.
    The defendant has failed to respond from the claimant thus denying any opportunity to bring the matter to an amicable conclusion.
    The claimant claims interest under section 69 of the county claims court act 1984 at the rate of 8% a year from 16/12/2016 to 29/07.2017 on £882.60 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £0.19

    Initially defending this claim as didn't recognise it. I do now remember taking the loan, it was a bad time and was desperate then forgot about it.

    Not sure i have a leg to stand on. Can i even change my mind and accept and pay if i stated i was going to defend?

    Any help greatly appreciated.

    Has anyone got any ideas? I want to just pay the money and avoid the CCJ now but i'm not sure how to do that now i stated my intent to defend in full?

    Can anyone please advise?

      If you pay in 30 days the CCJ doesn't go on your credit file.

        Thanks Mr C that's really handy to know, what should i do in regards to my defence? leave it and just pay the company? or write in by defence i was intending to claim as didn't recognise the debt but not i've seen the documents following my CCA requests, etc i would like to settle?

              So have you sent any requests off to the claimant or their solicitors? It doesn't seem quite clear- have they responded or did you send them back to them?

              If you haven't sent them you need to send a CCA request with the £1 fee

              I am not sure but there is no mention of a default notice. I find it a tad confusing as some PDL's send them and some don't. You could include in your defence that no S87 compliant DN was needed.

              Even if you put in your defence there is a stage called mediation where you could make an offer be it in full or regular payments and if accepted will not show as a CCJ

                Sorry if i wasn't clear. I sent a CCA Request asking for the documents that were mentioned in the Claim Form (Contract and Letter of assignment)

                Both of these were promptly returned to me.

                There was no mention of a default letter in the claim form, but i'm sure i probably received one? Who knows.

                Drastically running out of time to write a defence if i am going to write one, although i'm not really sure i have anything to defend? - I was hoping they wouldn't send me the documents.

                any advice appreciated.
