Ok to play devils advocate
I have highlighted bits in red that need some corrections, mainly spacing, I have made to comments in bold purple

Now a few points
Para 9 - what relevance is the NOA and DOA - what is the case law and which bit is relevant?
Para 11- which section of S78 is the request made under
Para 12 - Do you understand what that means - you will have to flesh that out in your WS and be prepared to explain

What about Notices of sums in arrears - what do they mean and what are the implications of them - I can;t help you I'm afraid cos I don't get it myself
What about annual statements - were they sent, are they important and if so why- again not my thing

I am only playing devils advocate and you need to remember you can not just throw something into your WS that is not in your defence

7K or is it nearer 8 with interest and costs ? is a lot of money when a few hundred quid will at worst leave you with a consent order.

Hell, I am no fan of big business and being a bit of a marxist at heart but you need to know your limitations. I like to think i am fairly clued up but I knew that defeating my claimant with what they sent me would be difficult for me, your claim is from 2012 or similar so they can and will no doubt cobble together a recon for your S78

Then what about part 18 questions - did you ask any ? How would you phrase them and more importantly what would you ask

Sorry of it sounds harsh but I feel you are taking this very lightly and it is clear Restons are bar stewards who will try to eat you up and spit you out

I really would recommend a lawyer be that pt2537 or Diana M or Joanna C

Ok, the spaces in the grammar is not on my word document, I do appreciate you highlighting them for me but it was just a copy and paste error, but thanks again.

Is it ok to PM you ? Thanks

You can PM me but I can not offer advice via PM - forum rules and all that

I appreciate copy n paste can screw things up.

Another point is to add a double space between paragraphs

Re: Possible letter before action from Restons

The POC do, according to what you say give a date the agreement was entered into- there must be much better ways to phrase it.

You say they do not know that but I am told they solicitors have produced screenshots of this forum as evidence

A few hundred quid may be the fixed fee for some or part of managing your claim via a solicitor

https://justbeagle.com/

Some do fixed fee but not all- again I believe the solicitors I mentioned earlier do

Thanks for the best wishes

Thank you

Being very helpful to people who are on the receiving end of county court claims for debts is my 'day job' (I work for a law firm which specialises in Consumer Credit debt issues).

You are dealing with a £6k+ claim so it's time to focus!

Do you own your own home (with mortgage)?

So from what you say you won't be at risk of a Charging Order now but that may change if you get a CCJ which the Claimant seeks to enforce against any property which you own in future (hopefully not).

Do you have job so at least an Attachment of Earnings can be ruled out if a CCJ is obtained?

Yes, I work full time and it's the AOE that I worry about if I were to obtain a CCJ

Try not to worry too much, I think it has happened when people have actually uploaded documents and left their names and addresses on them. I used to be awful for that especially in long letters but i have learnt - at the time I had a friend who was a mod and she forever edited my posts for me

It was just a warning that YTS kids in these firms do trawl various forums to see if they can gather evidence to use against a defendant
