  • Arrow Global court claim

    Hi just hoping someone can advise.
    I had an MBNA credit card which to the best of my knowledge defaulted in 2009. I have now recd a court summons for the amount showing legal team as Shoosmiths and claimant Arrow Global Guernsey. the particulars of the claim state that the regulated agreement was assigned to Arrow on 19.12.2011.
    I have sent a letter template for CPR 31.14 TO Shoosmiths asking for 1. copy of agreement 2.copy of default notice 3.copy of assignment. this was recorded on 14.07.17 I have not recd a reply to date.
    I also sent a letter template of CCA with the £1 postal order to the claimant being Arrow Global, I have recd a reply stating that they do not accept that they are the creditor as envisaged by the statute ie consumer credit act 1974 they advise that they are willing to assist in obtaining the document and will now process my request and will revert in due course. they also state that all collection activity will be suspended pending provision of the documents. ( they have returned my postal order )
    I have until the 8.08.17 to submit my defence and this reply has left me confused. I have acknowledged service. hoping that this makes sense tia

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
