    Hi everyone,


    I am very scared about some paperwork I received today.


    I got divorced in 2007 and got left with a tremendous amount of debt.
    I have been paying this off over the years but finally saw a debt counsellor about 4 years ago.


    I got a copy of my credit report and contacted everyone on there and made small affordable repayments.


    About 2 weeks ago I got a letter hand delivered and when I opened it it was from restons solicitors a CCJ form.
    This debt does not appear on my credit file.


    I thought I had 28 days to respond but today I got a letter saying judgement has been granted and I need to pay 1288 or it will be passed to bailiffs.


    I feel sick at the thouught that a bailiff could turn up.


    I am going to ring them tomorrow I tried tonight but they were shut.
    Do they have to accept an offer of repayment or can they just demand full payment.

    Do you still have the claim form that was sent?

    What was the date on it?

    Did you acknowledge the claim online or any other way ?

    The letter, is it from the court or from Restons. Maybe you could post it up removing identifiable info

      I havent returned it as I thought I had 28 days.
      Letter from court saying ccj has been passed and I must pay restons.

        OK

        When you get a claim form you have 19 days from the date on the form to acknowledge the claim, otherwise they can apply for a default judgement which it appears they have done

        There may be a chance to get it set aside but I am not sure how you would do that

          Ok.
          I presume they do not normally accept a repayment once judgement has been entered.
          I am so worried

            Well I can only tell you my very old ccjs were repaid at £5 a month. They should accept a payment plan

                ****UPDATE****

                I phoned restons this morning.
                I set up a payment arrangement that I can afford.
                The lady who took my call was very nice and helpful.

                Acknowledge Claim - within 14 days from Service

                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
