Posted previously for this case at http://legalbeagles.info/forums/show...271#post728271, current situation is that i have sent off a request for CPR 31.14 twice and this is being denied. As i have already submitted by defense I am unable to alter my defense until I receive the documents. I have attached the letters from Shoosmiths, there reason for not complying is that the claim is under £10,000. Yet the claim is not tracked, I believe that they are trying to stop me amending my defense. What can I do about this? should i write to the court to strike the claim out for non compliance of CPR 31.14, would this likely succeed.

You could write to the solicitors asking for permission to amend your defence although I do not know how to do this or what forms need using .
When it gets to Witness statement time you say it is SB and put the onus on them to identify the time, place and method of this payment . If you can look through your bank records to see if there was a payment that would help.
Not sure what your financial status is but some fees carry fee remission in the court if you are on a low income
If you have a little more disposable income have you thought about a solicitor, there are fixed fee solicitors out there

Acknowledge Claim - within 14 days from Service
Defend Claim - within 28 days from Service (IF you acknowledged in time)
