        Hello

        What can you do if you have not filled a CCA is there any way to rectify that I have 12 days to give a defence

        And the only helpful advice I have found is on here should I just send it anyway.

          It may help if you start your own thread since the title of this one (by another poster) is "Discontinued" so your questions may not attract urgent attention.

                    You should send the s77-79 CCA Request asap to the Claimant with a copy to their solicitors if they have instructed any.

                    You can also send the CPR 31.14 Request to the solicitors.

                    You may need help to complete the templates because they need your specific information to be added.

                    So post up (type out) the Particulars of Claim removing anything which could identify you. That will let us know who is claiming what and why they think they have the right to claim it.

                    What is the claim Issue Date? You have 33 days from that date to file your Defence. You say you've already filed the Acknowledgement of Service (I think I read that somewhere).

                      Thank you, I have sent an acknowledgement from and to amend my defence is due in nine days. I have been trying to find some information this whole time as I was not given any notice of this for 9 years for any information.

                          Do you mean that you want to amend the Defence which you have already filed but now have reason to want to file another one? If so you will need permission from the court to do that (i.e make an application).

                          Some Defendants enter a few words in the Defence box when they complete the AOS online by mistake. Did this happen to you?

                            It's 33 days from the claim Issue Date on the top right corner of the front page of the claim form (N1). What is that date?

                              You need to post more information about this claim in order to get tailored help.

                              What makes you think the debt is Statute Barred? There are lots of legal issues to consider before it becomes safe to assume a debt is SB and it isn't only when the last payment was made.

                              Can you start by saying what was the debt. A credit card, loan, overdraft, catalogue, mobile phone account etc?

                              When did you open the account, and if it was a loan when would it have expired if it had run until the end of the agreed term?
