Re: Motormile Finance/Moriarty Law vs Oggmeister

Hi charitynjw,

A day after entering my defence based on no documents they have sent everything requested and it all seems compliant.

I would guess my next steps would be to negotiate at mediation, as said previously I may have a family member who may help with some of the payment.

Thanks

Have you SAR'd PDL Finance?
http://www.legalbeagles.info/forums/...quest-template

Have you checked Credit Reference Agency lists to see if all info is correct?
Noddle & ClearScore are both free.

Obviously, without sight of the documents received, it's not possible to comment re compliancy.

MMF are currently on the FCA & Financial Ombudsman's radar regarding payday loans, & PDL/ Mr Lender loans are in the frame.
Have you explored the 'affordability/roll-over' issues?

At the mediation stage, if you decide to try & negotiate an arrangement to pay, it may be possible to agree a Tomlin Order.

Hi Johnnyboyrevel,

I agreed a payment plan through mediation, as they came up with the correct documation.

Hi can you help me - I wonder if you have time to read my post - I have recently received the proof from MMF re an old Mr lender loan I had- I do not want a CCJ and wondering if I should defend it or use mediation, not sure how I go about meditation. Is it possible you can read my thread re MMF please and offer any advice on what you did.

Hi elvis2003,

I am not really in a position to give you advice on how to proceed, there are plenty of expert Beagles on here who would give you a better idea on how to proceed than I could.

I can tell you what I did, after Moriarty Law came up with the relevant documents I agreed to mediation and a payment plan was agreed.

Hi Oggmeister,

I am in same position now as you,all docs just received and going to go through mediation and hopefully agree a settlement and payment plan. Did you manage to negotiate a reduced figure on the debt with MMF. I owe them £737 and with Court fees etc its nearly £1000. Am hoping to offer them like £400 to go away, and advice for the mediation ?

thanks

Hi xxmoomooxx

From my experience and talking to the mediator who told me how these things normally play out, they only tend to offer a reduction if you pay all in one go and it isn't much of a reduction to be fair.

It was my first experience of this though and you may have better luck agreeing a reduced settlement so good luck and let us know how you go on.
