County Court Claim from BW Legal for Excel Parking

  • County Court Claim from BW Legal for Excel Parking

    Hi all,

    I have received a claim form from the Northampton Business Centre for a privately issued Parking Charge Notice dating back to 15/7/12.

    I vaguely remember receiving some form of demand for this 'offence' in the past but can't provide any further detail. Unfortunately much of the post arriving at home over the last four years has gone astray due to my mothers dementia and her preference to tear things up (including anything she could get her hands on like birth certificates, house deeds and photographs).

    I do not remember the alledged offence contained in the POC but am sure they must have some form of proof with my registration number as this must be how they traced my name and address. This has been confirmed in a 'Notice of County Court Claim Issued' from BW Legal received a few days after.

    I have this morning Acknowledged service through moneyclaim online as I wish to defend the claim that is for the sum of £251-12! For an alledged parking offence!

    Am I doing the right thing and how best should I proceed?

      send a CPR31.14 asking for the documents/ etc mentioned on the court form, do not ask any other questions at this stage only what is mentioned in the court form! no charge for this info to the solicitors mentioned on the court form. for starters I am sure [MENTION=5354]mystery1[/MENTION] will be a long soon to assist you? send Recorded Delivery

          The "offence" was before POFA gave the parking companies the right to claim from the keeper if they did not know the driver. The can therefore only claim from the driver. They are not entifled to assume that the keeper was the driver. Don't tell them who was driving

              The driver was in Ebbw Vale at this time, I'm sorry but I really don't know anything about the car park other than it may have been the large, completely empty car park adjacent to the Domino's Pizza store.

                    Hi Peeps,

                    I have had a response from BW Legal stating that their client intends to continue with the claim and that they have filed notice with the court.

                    Do I need to respond to their letter and will the case be heard locally to their client or can I ask for it to be at my local court?

                      When the directions questionnaire arrives you put your local court. That's where it'll be held.

                              And the signage....
                              It seems almost deliberate that someone could park, walk behimd the sign to Dominos, buy a some food and not even know!

                              Who reads the entrance sign concerning parking at this time of night??
