    I am in the same position. They have sent no documentation about the claim or the CCA or responded to the CPR request. Mine is for £12k though. I didnt tick mediation at all as i have no interest in mediation. They have requested 30 days stay before having to pay the hearing fee.

    How do i force them to come up with the original CCA (pre 2007) or get it thrown out of court?

    If your claim is for £12k then Mediation may not have been available to you because it's only 'on offer' to claims allocated to the Small Claims Court.

    Unless in your situation the Claimant and you both agreed (acquiesced?) to the claim being allocated to Small Claims Track not the Fast Track at the DQ stage.

    If you've got a hearing date listed that suggests you have already filed a Defence and WS?

    Do you have a thread on the forum of your own for this claim?

      Yes i filed defence and returned the questionnaire. i have requested all the info and received nothing back. The claim is stayed for 30 days before they have to pay the hearing fee. if they pay that then im not sure what ill do. ill likely push for discovery to see documents and get a solicitor to fight it like the guy who seems to be beating hoist 12 times in the last 3 weeks

        Guy?

        Maybe there's also a "Gal" who beats Hoist on a regularly basis

        (or is this your Arrow Global/Drydens claim?)

          howard cowen have been chasing me for 3 or 4 debts for months. not sure if i ever made a specific thread. This is the biggest one which goes barred in jan and falls off my file in feb. But they put in a claim and i need them to discontinue it so it goes barred

            I won't go statute barred in January since a claim has been issued which stops the SB clock.

            It would be nice if the claim was discontinued but don't hold your breath because these things don't just go away, you have to make them go away.

            Why not start a thread on this claim of yours so help can be given if it's not too late

            What was the basis of your Defence to the claim? Maybe answer that question when these posts have been moved to your own thread.
