  • Moneyclaim for credit card debt, time to respond running out

    I am facing a claim from Drydens Limited in relation to an egg credit card taken out around 2004.
    I would like to see more details of the debt from the claimant so I can decide if I can adequately defend the claim, such as proof of a credit agreement and also details of when the last payment was made (as I am not sure if it is over 6 years).
    I have only a week left from the 28 days to file a defense (from the the service date, which I think is 5 days after the issue date). I have filled the acknowledgement of service online already.
    Should I send a letter to the solicitors with a request for documents at this late stage, as I would not expect a quick response, or should I try to defend against the claim? Also what information should I be requesting in order to determine weather a credit card debt is enforceable?

        you could request an extension to the time limit from the claimants (not the court) as part of your cca/cpr requests which you would then have to inform the courts about - if they agreed.

        it would help if you could give us more details of the "debt" and the PoC from the front of the claim form etc...

          Drydens is a firm of solicitors who are they representing.

          CCA request to the claimant with £1 statutory fee, CPR 31.14 request to Drydens ( no fee).

          What is the amount claimed?
          When was this account defaulted/ date of last payment?

          Does this account appear on your credit reference files?

          Get the two request off ASAP .

          This account being opened in 2004 requires the claimant to produce the original signed agreement.

            Amount claimed is just under £6000
            Last payment was 2011
            It does not appear in my credit file, I have just checked online and I have a good score with nothing outstanding.

            The POC simply states the amount outstanding to egg, that a default notice was served and not compiled with, and that the balance owed was assigned from Idem Capital Securities and to contact drydensfairfax solicitors with their phone number.

                Can you post up (type out) the POC.

                Is the Claimant Idem or possibly Arrow (a wild guess)?

                Your Defence deadline is 33 days from the Issue Date on the summons.

                Personally I see no reason to give the Claimant or their solicitors an extension of time to respond to your CPR 31.14 Request.

                The CCA Request deadline is a statutory requirement which is non negotiable.

                The Claimant should have had all the information needed before they issued these proceedings.

                    The claimant section says Arrow Global, so I think Idem assigned it to Arrow.
