Re: Small claims track - lowell portfolio - bw legal - witness statement

Why submit a WS 2 weeks before the due date?

Also, didn't you send a CCA request?

Re: Lowell portfolio - county court letter

I apologise if I have started too many threads I didn't know that I was to carry on on the same thread each time, I am really just looking for some friendly help and advice and thought I was going through the right course of action.

It's not my choice to submit a witness statement two weeks prior to the court date it actually states on the Notice that I am to deliver to every other party and to the court office copies of all documents on which he intends to rely on at the hearing. These may include:-
The Contract
witness statements
expert's reports
photographs
invoices for work don or goods supplied
estimates for work to be done

"The copies shall be delivered no later than 14 days before the hearing."

I have been looking at other threads on here and it does seem to be the done thing?

When I joined Legal Beagles I was told to ask as many questions and I'd like to obtain help, again I apologise if I've done something wrong, I have no knowledge in this field at all and really am blind to it all so asking for as much help as I can.

The CCA request I followed all the steps that were outlined to me using the templates. I sent both of the letters, not sure if I sent these correctly the as I've tried to exlain briefly, I sent a letter to the Solicitor using the CPR31.14 template and a letter to the claimant using the CCA template.

I would be most grateful for help and please remember I know you deal with these queries everyday but this is the first time I've come across this and don't know a bean about it.

Re: Small claims track - lowell portfolio - bw legal - witness statement

Hi,

For ease of reading double space between the paragraphs then a judge will not miss anything.

At para 12.

Say that the claimant should be ordered to produce the required documents within 7 days or the claim shall stand struck out.

Well done!

Thank you so much for your help nemesis45 I really appreciate it.

I was quite eager to prepare my statement ready to send off in a few weeks time before the cut of date so I can relax a little now as I'm also in up to my neck with my wedding due to take place next month, all happens at once lol.

Hi right colours

The point I think @charitynjw was making is that as you sent s77 and s78 requests, both of which you mentioned in your defence , you would be foolish, in fact plain stupid not to put them in your witness statement.

If if you don't it may get overlooked by the judge or by you when you have your day in court.

Sorry if I sound harsh , didn't mean to. Just wanted you aware of the importance.

Remember as well, most people on here are well intentioned and often knowledgable amateurs like me. There are a few who do this for a living.

Hi nemesis45 can I check as I have to send the witness statement before the 14 days prior to the hearing date, does this include weekend days or is it only working days, I am unsure and don't want to miss the date? The hearing date is 5 May 2017?

I wanted to check, I've now had a letter of discontinuance from BW Legal (Solicitors for Lowell), do I have to do anything or is it all just finished now?
