      Good evening, nem.
      I must admit that I hadn't factored that in!
      But it still could be relevant.....if it was close to SB before the claim was issued, it might be worth poking one's head above the parapet & ask for a discontinuance or going for the 'strike'.
      It's a gamble though.....whether poking the now-slumbering beast is worth it?

        It would have been SB in January. I think at the moment, let it be. The court would have to notify if a stay was lifted. I am scored about the tactic they tried. Would this come under some type of unfair practice?

        Is there any time limit on a stay?

            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
