  • Lowell county court, help me please

    Summary:

    05/05/2016 - Lowell issue county court claim

    26/05/2016 - Sent CPR 18 and CCA request (with £1 postal order)

    - Unsure on exact date I submitted defense but was in time

    08/07/2016 - Lowell Solicitors responded stating the Deed of Assignment was 05/01/2015 (in the court claim they have stated 31/12/2014). Which one is it?
    They have requested most recent documents from client and will forward these on to me but haven't received anything.
    Said my agreement start date was 30/10/2010.
    Defaulted 29/08/2014
    They rejected my request for the Deed of Assignment and sworn affidavit.

    29/09/2016 - Letter from small claims track, court date set for 13/01/2017.
    They are required to pay the fee by 16/12/2016
    In the letter from the court it says;
    7) The original documents must be brought to the hearing.
    8) The judge may refuse to consider a document or take it into account if a copy of it has not been sent to the other party as required by this order.

    Mediation recommended, once again mediation say unsuitable.


    Can anyone advise me on what I can do?

    I wish I took mediation to end all this, it's affecting my mental health a lot now to a stage where I'm being referred by the doctor to have a mental health asssessment, is it possible to ask for mediation? I just want it over with :/

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
