      Received the mediation notification in the post, but it states that both parties have to be flexible when entering into negotiations. How can I be flexible when they haven't provided the requested information?

        The judge considers the case suitable for mediation But if you don't have all the documents that the claimant intends to rely upon the mediators are most likely to decline the mediation as you will be seriously disadvantaged.

        If this happens then the HMCTS will refer the claim to the nearest county court to your home for a judge to give directions as to how the claim is to proceed.
