We have a Court date in September so had to send in our documents to be used as evidence as required by the court by 17 August 2016.
Sent documents by special delivery to the Court (received on the 15th) and claimant (received on the 17th).
Postman came today and has not delivered anything from the claimant even though they should have according to the Court Notice.
Went on to MCOL to see if it had been updated but it hasn't, but did notice something odd.
From MCOL.......
DQ sent to you on 06/05/2016
You filed a DQ on 23/05/2016
General Sanctions Order was made on 28/05/2016
DQ filed by claimant on 07/06/2016
I've just checked to see what the General Sanctions Order was for. It appears that the claimant hadn't filed the Directions Questionnaire by the due date and was given 7 days to do so from the service date 28/05/2016
The order states that “If the Claimant does not comply with this order their claim will automatically be struck out without further order of the Court”
Does this mean that the claim should have been struck off in June? And surely I should have received all of the claimants evidence by now?
Should I go to the Court to find out what's going on? Its 10 minutes down the road.
