    Hi Vinnie

Could it be any worse than the copy that you posted the other week?, lol.

Illegible, no T&Cs, so imho, unenforceable.

      Hello.

I have the 2 bits of what i got in the post yesterday attatched now so you can see what the "new" CCA looks like.
This is all i got in the post, not T&C's, nothing on the backs of the letters and nothing else.
I will have to wait and see what happens after i dont respond to their 14 day settlement threat.

        Hi 1vinnie

Imho, Miss Armstrong, Trainee Solicitor, needs a bit more training.
It's still illegible, still no T&Cs, still unenforceable.

        http://www.legislation.gov.uk/uksi/1...ulation/2/made
Legibility of notices and copy documents and wording of prescribed Forms

2.—(1) The lettering in every notice in a Form prescribed by these Regulations and in every copy of an executed agreement, security instrument or other document referred to in the Act and delivered or sent to a debtor, hirer or surety under any provision of the Act shall, apart from any signature, be easily legible and of a colour which is readily distinguishable from the colour of the paper.

I got a letter from Restons this morning.
There was a badly photo-copied CCA/agreement which i the same as the one i got from Arrow 3/4 weeks ago but this one must have been a copy of the copy.
It is very hard to read it. It is still just one page and no T & C's with it.
Restons say i clearly took out this CCA and now pay up.
Looking at the paper which has confussed me for months is that the card i took out was from Alliance and Leicester and not MBNA which the POC state the agreement is with.
I know MBNA took over A&L credit cards a few years back but will that be of any help to me?
I will try an get a copy of the letter up on here today.
              Good morning,

From what you say the " agreement " does not meet the requirements of VVA 1974.

In my post#83 there is a copy of the CCA that i was sent from Arrow. It says agreement at the top but the one i got from Restons has other bits at the top like letters/numbers about my account so i left them out.
I think the copy has been copied lots of times as its very hard to read and thanks for telling me that it doesn't meet the CCA1974(VVA1974) so i will wait for their next letter in 2 weeks asking for me to pay them.

I have had nothing from Arrow or Restons but i am expecting a Christmas letter from Restons in a day or two as they said if i dont contact them within 14 days with a settlement offer then they will continue to CCJ me.

                          Hello.

It has been a while since i had anything to write in my thread.
This weekend i got a letter from Rest and it was a "without prejudice" letter waying they are still trying to get the docs fron the client but the client has told them if i pay £3600 now which is a 25% discount on the claim total they will mark my file as partilly settled and they will NOT come after me for the rest.
It looks like it have to go to court as i cant afford to pay £3600 and most i could pay is about £750 which they wont accept that will they?

I hope you all are keeping well.

at any stage if took up the deal would be pay so and so, then you would state confirm that any balance would not be sold on, not rely on them saying they would not chace - get the drift//
