      I'm not in a position to comment on a Defence which has been written by someone else especially if I've not seen any of the associated paperwork with my own eyes.

      Have you considered sending a Subject Access Request to MBNA so you've got the full history of this account which was opened in 2008 (the date you say was stated the POC)?

        I have now received notification from PRA that the court have notified them of the defended claim, and they have sent me a letter saying they have told the court they still wish the claim to go ahead.

        Subsequently the court have sent me notification of allocation to the small claims track and an N180 small claims directions questionnaire. This has to be returned and served on other parties by the 29th September.

        Meanwhile PRA have sent me acopy of their claims direction questionnaire.

        What to do now? They still havent sent me the original agreement so I dont see how the matter can proceed without this????

          Hello Mulls,

          Despite not having the agreement you Must complete both the Allocations Questionnaire and the N180 DQ and send a copy to the court and the claimant/solicitors.

          If you have any probs with the answers come back here for advice and someone will go through it with you.

            I take it to tick i agree to mediation? Obviously I had hoped this would have been thrown out by now for them not having the relevant documents.. I obviously need to get this completed and posted today for it to get back in time...

            If I agree to mediation, do i still receive a CCJ???

              Mediation is an opportunity to negotiate a mutually acceptable solution to the claim, however if you don't have the documents to enable you to properly take part in the mediation it will not take place.

              In this situation the claim will be allocated to your local county court for directions.

                  Hi guys and gals.
                  I received a call from the court about mediation. I explained that I had not received all the relevant documentation, and they said take some time to think about whether to go ahead with the mediation.

                  In the meantime I have now received a bundle from PRA, containing the credit agreement and a letter inviting me to withdraw my defence with the court and notifying them when this done, so that a tomlin order can be obtained.

                  DO I contact the court and ask for the mediation, or withdraw the defence? obviously I think if I can do the mediation and come to an agreement, there is no tomlin order..

                  any suggestions? I am in the middle of a weeks employment tribunal at the moment. which is taking me back to a dark and depressive period during my life, and I could do without the e4xtra pressure at the moment.

                              the "credit agreement with my name and address on is in the first post above, with the black editing at the top after the assignment notices.. the address doe seem to be the same yes..
