  • Lowell send me papers for court hearing

    Hi,I have received papers from lowells today ready for court hearing next week.There is no signed agreement with them,Or default notice,And the solicitor confirms that they don't have a copy of the agreement or default notice.
    There is nothing at all with my signature on it,So what do you reckon will happen in court?

      Have you filed your witness statement?

      If possible please post a copy of this "letter" so we can assess what has been done.

        Hello,Yes it is their witness statement I have not filed one for me,As I am defending my case with the fact that they have never sent me documents that I asked for ,namely agreement and default notice,So I have not had any other douments to send I have no means to post up the letters,But it says,Unfortunately the assignor has confirmed a copy of the agreement and default notice is not available,Also it claims that I have no reasonable chance of success,And that my defence should be struck out.It is then signed with a statement of truth.Thanks,Vale

          Ok I hope the judge does not query the lack of a WS if you have not disclosed any documents You intend to rely on then you may be prohibited from using them.

          You would have had notice from the court that the parties to the claim should disclose all documents At Least 14 Days Prior to the hearing.

          When is the hearing?

              Might be a good idea to get a WS put together with copies of any " evidence/ exhibits " you want to rely on and get is served asap on claimant and court.,

                Hi,I did see the fortnight deadline for sending defence papers,But I have nothing to send. This account was opened in 1997,And I never signed an agreement,In fact,I never paid any money,My partner paid it with his credit card every month,And that was the way it was up until he died,Hence the reason I could not pay anything after that.
                All his accounts were done by himself,And I know it sounds stupid,But I never paid any attention to the money side of things,He paid for everything.
                I am quite worried that the judge will order money to be paid,As I am only receiving sickness benefits,And I get full rent and council tax paid,So paying out more money to these sharks would leave me very low on money.

                Acknowledge Claim - within 14 days from Service

                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
