    The I've not heard from ME III re the CCA

    Restons replied to my CPR saying that I would have been provided with the T&Cs when I opened the account hence they see no reason why I would now require an additional copy. And although I've requested other documentation the PoC contains sufficient info.


    just so that I'm clear (apologies) if Restons or ME III don't provide a copy of the documentation requested within 28 days from the 16 Sept they can't claim the money? And if they do respond will they send it to me or the court?

    You've filed a Defence and the court has written to you to confirm that on 16th September they sent it to the Claimant's solicitor who was given 28 days to inform them (the court) if they wish to proceed with the claim. If they don't inform the court within that timescale then the claim is automatically stayed.

    You have sent a CCA Request and a CPR 31.14 Request.

    If they can't provide the credit agreement (or an honest and accurate recon of the CCA) then they will know that they can't enforce the debt in court since the account was opened in November 2006 according to the POC.

    If they don't provide the documents you've requested in your CPR Request then they will be in some difficulty.

    In the meantime I can't think of anything you should be doing. If they don't respond to you it can only be a good thing at this stage

    i have attached the particulars

    I have sent a CCA s78 request to ME III on 19th August along with £1 cheque and not had a reply!

    I haven't acknowledged the claim

    I've had a reply from Restons regarding the CPR 31.14 request and I don't understand it. I submitted the NB9 defence form to the courts at the beginning of the week and had a reply from the court today to. I have attached both letters.

    basically Restons are telling me all the info I needed was in the claim and that the terms and conditions were supplied to me when I originally opened the account!

    whats my next course of action?

    They didn't mention any documents in the particulars just the account number and the following

    Date: 06.07.16
    Item: Default balance
    Value: £992.43
    Post Refrl Cr NIL
    Total: £992.43

    I asked in this thread if I need to put anything other than the account number

    Hiya xx

    You've made a great start there.

    Paragraph 5 - as it does state the opening date of the agreement you can remove that paragraph.

    Paragraph 8 - do you mean you only put that as a reference when you sent your CPR 31.14 request ?

    Paragraph 12 - probably a little late now for negotiating an extension so just remove paragraph 12 completely
