  • Received claim form - county court business centre

    Hi,

    Have been lurking the forum for a while, however only just had the need to join.

    I received a County Court Business Centre claim form today through the post. It's regarding a debt of £568 with o2, currently owned by Lowell Portfolio LTD. I've checked my credit report and I took this out on 30/03/2010. The default date is 14/06/2012, so I know statue barred isn't an option.

    I'm wondering what my options here are. I know I have to acknowledge this, however am I able to partially pay this and offer a sum I'm willing to pay and then pay this in installments? Theres a hell of alot of interest that's being added on top of the above sum.

    You must first acknowledge service of the claim online at MCOL and at this stage state intention to defend the claim in full.
    Who is adding interest to the alleged debt?

    More background will help us to advise.

      Hi, Thank you for your response. I have acknowledged the claim and defended. Apologies I work nights at the moment, so it's hard to reply in the day. Why should I defend the claim at this stage, in case they drop it?

      With regards to who has added the interest, I'm currently unsure. What other information would you like?

        No problem Aaron,

        What type of account does this debt arise from?

        If you can please post a copy of the claim form after removing personal identifiers, or type in the Particulars of Claim word for word.

          The account was with o2. I took out a contract with them.

              You've acknowledged the claim, so that buys you a bit of time.

              Have you sent a CPR letter? (to the solicitors, no fee needed, proof of posting essential)

              From what I can see, there's about £45 interest added, the rest being court fees & sols costs.

              Do you have a copy of the original agreement?

                Hi,

                I haven't sent a CPR letter, what is this? Unfortunately I don't have an original agreement, it'd be a miracle if i did.

                  Top of this thread in green you'll find an example CPR 31.14 letter, usually sent to the claimant's solicitor, no fee needed, proof of postage a must-do.

                      If so then they need to discontinue the claim and not treat the payment as an admission of liability for the debt so you may still get a CCJ.

                        Hi,

                        Yeas I paid Lowell and the dept is closed. They told me on the phone that the account has been closed and will not be continued as a CCJ. They have also said that the dept with take up to 60 days to be taken off from my credit check.
