  • I have seriously messed up, I don't know what to do.

    Hi everyone, I am new here, I am in serious need of some advice.

    I really don't know where to begin correcting my own silly mistakes. I am in real hot water at the moment and I am really scared.

    I have been daft enough to ignore court claims made against me, I know that is a really stupid thing to do (I didn't know at the time, but I do now) I received a letter today from Mortimer Clarke Solicitors saying that their client (cabot finance) has instructed them to apply for a warrant of control, and that Bailiffs will soon be sent to remove goods unless I settle the debt within 7 days.

    I also had a court claim from water rates a few months ago, that I ignored. I have just checked my credit file on Noddle and I actually have 3 CCJs on my account.

    I don't know what to do, I have been told that there is nothing I can do other than settle the debt (Which I can't afford) or Bailiffs will be sent.

    The idea of Bailiffs in my home is making me feel incredibly frightened.

    Is there nothing I can do? If anybody has advice on this I would be very grateful.

    If you are on a low income you may be eligible for a reduction or remission of court fees.

      Could you give an idea of your overall situation? Ignoring court forms suggests to me that you may have other debts as well?

      What is the total amount of the CCJs?

      Any idea what your other debts add up to?

      Are you buying or renting? Are you in work? Can you realistically make any payments towards these debts?

        Hi everyone.

        I haven't had internet access since my original post, I am back on now.

        This morning I have received a letter from The County Court Business Centre. It says that a Bailiff will call and may remove goods on June 21st. The title says "Notice of Issue of Warrant of Control"

        The letter has a case number, a warrant number, a local number and creditors reference. Is it too late to contact and offer a payment plan at this point?

        Debt Camel you are right, I do have other debts, to be totally honest I feel completely swamped and have no idea of how to solve this situation. I am on Universal credits at the moment and have been for few months now. I received £268 per month and I pay £137 straight out of that in rent. So as you can imagine my budget is quite tight as it is.

        This letter I received this morning doesn't mention Mortimer Clarke, it only mentions Cabot. I have 3 CCJ's on my credit account, totalling nearly £3,500. Other debts included would add up to more than that.

        Should I go ahead with the N245 form? Or perhaps contact the court directly, I have googled and they have email addresses to use. With happens if I offer a payment plan and they refuse it? I won't be able to offer much at all given my current circumstances.

        Sorry for all the stupid questions, I am really eager to get this sorted out. I really appreciate the help here :-)
