I would in the first instance make a formal complaint to Najib Nathoo CEO RW, about the abuse of the CCA request which is a " Lawful Request For Information and copy it to the FCA in detail " for information".

If you need help with a letter let me know.

Re: Hoist Portfolio CC claim v Anaconda

            Hi Nem
With regard to this claim I sent off the defense approx 6 weeks ago and received an acknowledgement from the court on 17th June. The defense basically outlined the reasons it was statute barred in my opinion and that I had corresponded with both Hoist and Cohen the solicitors requesting information. I stated that I had not received any documentation back other than a returned fee of £1 from RobinsonWay.
I heard nothing more until this morning, over six weeks since my reply from the court, when a second letter came from the court which looks like a copy of a letter sent to the appellant ' Notice of Proposed Allocation to Small Claims Track' saying this is now a defended claim and a form N180.
What should I do now, am I required to complete the form and return it to the court and what should my answers be to the questions.
            Hope you can help
            Regards
            Ana

Re: Hoist Portfolio CC claim v Anaconda

I am a little behind you (sent my defence on 15th June) and it is now 2 weeks after their 28+5 days deadline to respond...
I would be royally pissed off to get anything from court so late as for me it is not my problem that court is understaffed (they pocketed £185 from Hoist so should act within legal time-frame).
Anyway, status is defence on my mcol page and if it is not the correct one after 2 weeks then I do not know what we can say about law in this country when it's very own institution cannot stick to it and abide by its own rules...
                  Wish you good luck

                    Hello Ana,

Yes complete and return as specified in the notice, it's just court process.

Give the court a call on Monday be cause if the claimant has not responded to your defence within 28 days from receiving the defence the court may have " stayed" the claim.
