    Hi I opened in at the start of March 2007 and I did the online application then. Lowell gave me 30 days to have everything checked out and the 30 days is about to expire, they are relentless. Okay I'll post a redacted copy tomorrow, it's easier to do that at work. Many thanks.

      Hi attached are the relevant documents or at least the documents I've received. They are the credit agreement and two copies of the T&Cs, one had the address on it from when I took out the card and the other had the address on it from when I did the SAR (to HBOS) almost two years ago. I received the T&Cs from HBOS and not Lowell, Lowell refused to send them to me. I am still waiting on the SAR documents from Lowell.

            On the advice of this forum I did a CCA request and the credit agreement took months to come through. They then said that they wouldn't collect the debt until they had received the terms and conditions for the debt from HBOS. A few weeks later they wrote back and said that they didn't have to provide me with the terms and conditions and if I wanted them I'd have to ask HBOS myself.
            Do you still have this letter?
            Of course they should send you the T&C's at inception of the agreement plus any subsequent varied ones.
            & they are well aware of that obligation.

              They have now sent me a copy of the T&Cs which must have been provided to them by HBOS, I'm just trying to establish if the debt is enforceable or if there is something not quite right with everything. I was asked to post a copy of everything which I did a few days ago. I just wondered if everything was ok and if it was enforceable or if there was something not quite right. I don't know if they are legally compliant.

                  It's a gut feeling rather than anything concrete. I was in a failed DMP and took everything over myself, that was two years ago. When I started doing CCA letters and SARS to all my creditors this debt was with Robinson Way, I'd set up a monthly DD with them and out of the blue they cancelled it and said the account was in dispute but gave no reason why. They didn't collect anything for over a year, then out of the blue I hear from Lowell who have bought the debt and are looking for payment. I've read Lowell have a bad reputation and my experience with the failed DMP has left me suspicious and cautious, if there is something not quite right then I'd like to challenge it. Maybe everything is ok and I just need to enter in to a repayment plan with them.
