Statute barred ? Or is it ?

Hi I've just put in my defence for a debt that was from Nov 2004 stating it was now statute barred , the court sent my defence to the solicitor dealing with it . They have now wrote back saying last payment was made in October 2012 and have invited me to withdraw my defence and make a payment plan !!! I have no knowledge of making a payment in 2012 at all , how should I now go forward ? Many thanks in adavance

Hi it's for a catalogue account and its from Mortimer Clarke solicitors but it says Re Cabot financial uk limited v me , thanks ( hope I've done that ok lol )

I thought is sounded like Carboot Cowboys and their " in house solicitors".

Is this a Shop Direct Group Catalogue?
Seen one similar " alleged payment" recently which turned out to be a refund on returned goods.

Personally if you have the account number I would give the accounts department manager of the company to see if they can confirm or deny MC's claim.

i don't have any details of this account as it was over 12 years ago , I was wondering should I send a letter to them asking to prove it ? Thanks so much for your help Nem

Would it be worth sending CCA & CPR requests at this stage as well?
I was thinking that the s78 might stop them in their tracks.

As Charity has said a CCA request is well worth doing ( template in green box above) a £1 statutory fee is payable, use a Postal Order marked " for statutory fee only" on both sides make a copy and keep for your records.
Send by signed for post check delivery date and signature and print off a copy.
