  • Shop Direct Court Claim

    Good evening all.

    I have been sent to this forum by a friend to seek advice.

    I have recieved this Court Claim for an old catolgue debt, which in all honestly I totally forgot even existed, as it was at a time in my life when I was left my own with my then 8 year old daughter, (yes I am a man!!)

    I obviouly do not want a CCJ against me but would like to fight this claim as I am sure some of the goods were returned. The amount they are claiming does seem very high.

    Right, first of all you have come to the right place. I am sure one of the smart beagles will be along tomorrow to help you out.
    I know this is easier said than done but do try not to worry. When you have a bit of time have a bit of a browse around the site and you will discover you are not alone and this is not the end of the world.

      Have you acknowledged the court claim?

      Please complete the steps shown in the green bits at the top of this thread.

      When was the last time you paid into the account, or acknowledged it in writing?

        Thank you for the reply. I haven't done anything with the claim yet as I was awaiting advice on here. I honestly can't remember the last time I paid anything in to this account, but I would think its getting on for well over six years.

          Have you acknowledged service of the claim?? If not you are running out of time and could easily end up with judgement by default.
          Acknowledge via Money Claim Online instructions are on the form you have I think about 48 hours to do so, State intention to defend in full. Do Not make any statement in defence at this point.

                Only if you don't live in England or Wales (IE if you live in Scotland/Northern Ireland)

                        Have you sent off cca and cpr requests yet?? If not, do so (from my link in post #6)

                          In your CPR request (http://www.legalbeagles.info/forums/...ic-information), you can ask for copies of things mentioned in the PoC on the claim form:



                          So ... that's the AGREEMENT the DEFAULT NOTICE and the NOTICE OF ASSIGNMENT.

                          The CCA request (http://legalbeagles.info/forums/show...y-of-Agreement) is for a copy of your original signed agreement (and the terms). You'll need to send a £1 postal order with this letter marked "for statutory fee only" and keep a copy of it for your records
