  • Question about CCJ Set-Aside Hearing

    Good afternoon,

    I have applied to put a CCJ put aside and have a hearing on the 3rd of May. The CCJ occurred because paper work was sent to my previous address and not my current from a well known parking management company ending in the word eye. I have already sent away a witness statement with the set-aside court form N244 and proof of my leaving address and evidence of my current tenancy agreement showing when I moved in.

    As I do not want to be let down at the hearing I want to be as prepared as I can be. If I wanted to produce additional evidence during the set aside hearing do I simply bring this with me (i.e. dates I informed DVLA and a letter from claimant with my new address on it)? I will of not sent this away with the original form I completed.

    I have not heard anything back from the claimant (parking company) as well so do I assume they will turn up to the hearing as well? What can I expect to happen on the day and after the hearing?

    I would send copies to the court and the opponent as soon as possible and take the originals with you.

    Make sure that you read the CPR on set aside which dictates that if sent to an incorrect address the set aside MUST be allowed.
