    Hello Beagles!

    I'm having some problems with Lowell; just like many others on here, which has reached the point of a County Court Claim Form being issued to me. Ill break it down for you below.


    The claim refers to a mobile phone debt with Vodafone from way back that has been passed from collection agency to collection agency. I have told a couple in the past over the phone that I did not accept the debt and they would have no chance of getting any money from me. They all dropped it after but Lowell have been more ferocious.

    I was young, dumb and drunk resulting in losing my phone in central London. Took me about 3 weeks to inform them off the loss at which time the bill was raked up to over £2000 (obviously not by me). The phone records showed calls to France, Morocco, and other areas in Europe and Africa. When I challenged them about the calls obviously not being made by me they just told me I should have informed them of the loss sooner. Funny thing is Vodafone blocked the SIM themselves after 2 days because of "unusual activity".



    I received a Letter of Claim from Lowell dated 16/12/2015. In response I sent a recorded delivery letter asking for documents like original Vodafone contract, Default Notice etc as advised by FlamingParrot : here :.

    In response I got this from Lowell Solicitors;

    Date 18 January 2016

    Dear Sir

    Our Client: Lowell Portfolio I Limited
    Our Reference: 141438077

    Thank you for your letter of 19 December 2015.

    We note the contents and write to advise you that we have requested documents from our client and will forward these to you upon receipt.


    Since then I have received no letters or documents from them. Now today I received the claim form.

    So my question for you is, where do I stand and what should I/ am I required to do now? Do I have a good chance of getting this dropped if they have not sent me the documents required by the Practice Direction Pre-Action Conduct?


    The Claim form is dated 24th March 2016 so I would like to get on top of this ASAP, I don't want to get caught with my pants down :judge2:.

    Morning Beagles

    I just received a letter dated 29/03/2016 titled Notice Of Claim Issue.

    Once again offering me a payment plan to clear the debt.

    Really need some help here!!!

        Good morning,

        Have you acknowledged service of the claim? If not do so now online using Money Claim Online (MCOL) state intention to defend in full But do not make any statement in defence at this stage.

        Claims via the Northampton County Business Centre cannot have documents attached.

        Please post a copy of the N1 claim form after removing the claim number and your name and address.

            So I have disputed it on the MCOL website but have not gone past step two; dispute reasons. That means im logged as responding right?

            Just double checked and I had not filled out the AOS part, done now
