Reinstated Court Claim - Lowell/BW LEgal

  • Reinstated Court Claim - Lowell/BW LEgal

    Good morning,

    I am hoping that someone can advise me on my next steps. My original thread seem to dry up on advice, meaning I ended up not attending the court hearing because I didn't have a clue what to do or say.

    The original Court Claim was set aside because Lowell/BW Legal filed their "papers" late. However they applied to have the claim reinstated which was successful by the looks of it.

    I have now received the following papers. the one from Lowell/BW Legal arrive a week before the court letter.

    Any help is much appreciated as I am at my wits end and losing sleep over this.

      I would call National Debtline ASAP to talk it through with someone to see what they think.
      Be aware that Lowells are a debt collector that has a habit of finding "phantom" payments within the 6 years, which they mysteriously can't prove if pressed on the matter, but that can cause problems if a judge is one who tends to take a creditor's word for things regardless of evidence. There are a few.

                Thanks nem, it is appreciated, Some of the paperwork is questionable. I informed British Credit trust that I had moved in 2009. However, some of the "paperwork" BW have supplied allegedly from BCT has my old address on with dates well after 2009 on!

                  Did you get a default judgment against you which you then got set aside or did BW Legal discontinue the claim?

                  What was the order of the 3rd of December 2015?

                    BW/Lowell applied to have a CCJ against me, I fought it and had to submit my defence etc. BW were late submitting their "paperwork" so the Court struck it out. BW then applied to have it reinstated which the court have so now I am back to square one and at a loss at what I should do next.

                        So they have now responded
                        Well next step is DQ followed at some point by witness statement

                        Have they supplied documents

                        When you complete your witness statement you can point out all the error

                          Thank you. But what is DQ?

                          They have supplied some "documents" this time yes but I am not convinced by their authenticity at all. Any ideas what to put in this defence? I submitted one when I fought the CCJ application last time.

                            could you remove personal info and post docs up
