  • Received a CCJ claim form on a Statute Barred Debt - with a twist...

    I received a claim form at the beginning of the month. For a credit card debit (over £10,000) that I believe to be Statute Barred. I have original bank statements which show the last payment (back in September 2009). A Letter from the credit card company (in November 2009) requesting payment and stating that the account has been suspended.

    No payment has been made since then nor any acknowledgement of the debit.

    I’ve checked the FCA register and the Claimant as stated in the claim from has never held a license - simply: nothing is returned.

    If the corporate identifier (LTD) is removed then two results are returned (both ending with Limited, not LTD). The Permission End Date for both were back in September 2015.

    I phoned up the FCA last week Friday to confirm that the results on the online search were up to date. The person I spoke to could not find anymore information than what was already available on the register and confirmed that the register was up to date.

    My position so far:I have submitted the Acknowledgment of service online, with: “I intend to defend all of this claim” selected.

    I’ll be sending out letters to both the claimant and their solicitors requesting information as shown in other areas of this forum.

    The area I’m not sure about is the License issue. If anyone has any more information on what to do, It would be greatly appreciated...

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
