    Issue Date: 22/02/2016
    Amount approx: £904.91 plus £60 court fees
    Claimant: 1st Stop Recoveries
    Solicitor: None
    Original Creditor: Uncle Bucks
    Particulars of Claim:
    ‘1st Stop Recoveries Ltd claim this amount in respect of an unpaid loan funded by Uncle Buck Ltd. The defendant failed to abide by the terms of the contract. 1st Stop Recoveries purchased this debt from Uncle Buck and subsequently sent a notice of assignment of assignment to advise. The defendant has failed to respond to any correspondence or Communication from the claimant thus denying the Claimant any opportunity in assisting the Defendant in attempting to bring the matter to an amicable conclusion.
    Is the debt Statute Barred? No
    List any letters you have sent: CPR and CCA requests to 1st Stop
    Any Other Info:

    Over the last weekend I have been in touch with Sara at 'Debt Camel' regarding a claim of mis-lending against 'Uncle Bucks' regarding the fact that I had 5 loans from this company over 5 months and they did not check affordability. I am now preparing a claim against them.

        Emmm, I didn't think they were licensed for debt purchase I've looked at the FCA interim permissions register but the IP is rather vague so asked for clarification.

                Hi, I have to say I cannot recall seeing a claim from them in the past just one or two DC problems which were related to their own loans.

                Can you post a copy of the claim form for me please.

                  This is what the IP says

                  Entering into a regulated credit agreement as lender; and exercising, or having the right to exercise, the lender's rights and duties under a regulated credit agreement.
                  Therefore they are licensed or at least that is how it seems

                      Have you taken any action yet such as
                      Acknowledge the claim
                      Sent a CCA request (probably pointless but worth a shot)
                      Sent a CPR31.14 request asking for the agreement and the notice of assignment

                        Some help needed on this please.

                        I sent the requests to !st Stop as suggested above (by post) and they have emailed documents to me.

                        However, I have been in touch with Debt Camel through a link on this site and they have been extremely helpful. As I had 5 loans in 5 months from Uncle Bucks culminating in the £879.87 I was unable to pay, they have helped me draft a complaint to Uncle Bucks (copy to 1st Stop) asking for refund of interest and charges plus asking the to write off the money owed. Also to suspend any action until my complaint is dealt with either by them or the FO. I have not sent this off yet but will do.

                        However, I still need to submit a defence to the court by Friday, 1st and am not sure what the enter so advice needed.

                        Sorry but I have not been very well and not functioning at 100% but determined to get this sorted.

                              What are your thoughts on points for a defence e.g. the loan should never have been granted because of others already taken and remaining unpaid?
