    Hello everyone!!

    So, it has been 1 month since my defence was subm etc butitted. I received a letter from the court saying they sent a copy to the claimant but as of today, i still haven't heard about the CPR and the CCA request, and no other communication from Lowell.

    Is this normal, should i be chasing them for anything? Many thanks in advance!

      Hi you need to check with the court to see if the claim has been stayed ( Lowell not having responded with in 28 days of receiving it.

          Carlos, on both threads you have asked this question, the court has stayed the claim because the claimant did not respond to the defence, this is an automatic process.

            So apparently i should have received a letter saying the claim has been stayed as it is done automatically if Lowell did not reply. Today i received the attached letter. Lowell said the court should have sent me a copy but i didn't receive anything.

            Can anyone advise, i have read the letter and cannot make sense of it! Thank you all in advance!

                    I am in exactly the same situation as you - but with Halifax. Did you respond to the letter of claim they sent before the county court ?

                              There is no notification required from the court or the claimant when the court stays a claim because the claimant has not responded to a defence.

                              Possibilities:

                              1. Write to claimants solicitors requesting that they discontinue the claim as they have little or no prospect of taking the claim forward to trial.

                              2. Give the claimants solicitors 7 days notice that you will make application to the court for the claim to be struck out and you will apply for the court to order their client to pay the cost of the application.
