I get fed up with shyster solicitors attempting to confuse, discredit alleged debtors in the hope that they will give in and pay up there legislation and regulation which these idiots must be made to comply with.

Quick update on this one, before I got chance to send the last letter off to Restons I had two replys from Cabot. Stating that they do not have the information requested but should do in 40 odd days etc... So I amended the letter to state that I'd already received this. So Friday this week I've received a reply to the letter kindly put together for me by nemesis45 attached is the reply, stating much the same as their previous letter.

Ok

Mark,
Did you request anything other than the documents specifically mentioned in the particulars of claim?
If so edit and sent the CPR request again.

Yes in fairness nemesis45 I used a standard template asking for everything under the sun. The only thing mentioned in the particulars of claim really is 'a contract'. Between myself and capital one. I'm assuming this is what I should have asked for? Do I send this request to Restons too? I assume they keep the poc's vauge for this exact reason?

Correct that template is useless and will always be rejected even where CPR31.14 is in order.

1. The claimant claims payment of the overdue balance due from the defendant under a contract between the defendant and capital one dated on or about jul 26 2000 and assigned to the claimant on sep 28 2015

ac no. ********
date item value
15/01/2016 default balance 749.21
you could ask for the contract and notice of assignment and possibly the default notice here
