  • Cabot court claim

    I received a court claim today from the business centre at Northampton, this was from Cabot, Restons solicors. This is from an alleged Capital One account dating back to 2012 for a balance of 1700 but now 1900 with court fees. I dont recall having a capital one account but its possible. The date on the claim says 05/02/16 but i havent received it until today 16/02/16. I am concerned due to the little time I have left. I have written a CCA to Cabot to post tomorrow but im unsure with regards to how long I have left as i believe i have 14 days plus 5 but its taken 11 days to receive it. Any help would be much appreciated

    I wouldn't worry that much . Have a look at the links in green to get help. You have until about 22nd to acknowledge the claim and another 14 days after that to lodge a defence.
    Get the acknowledgement done, get the cca sent off and a cpr request requesting only the documents mentioned in the claim.
    That will do for now.
    You could check your credit file to see if it's mentioned on there but I suspect it will be

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
