Kaljo - Cabot/Nolans court claim

My husband has received a court summons from Nolans solicitors acting for Cabot for a debt from 2005 but the summons states he made his last payment in 2013 which rubbish this has not been paid since 2005. Do you have to reply to the court summons to dispute the claim the contact the solicitor requesting this information about the last payment or would you contact Cabot? Thanks

Who was the original Creditor?
What type of account was this?

Does this debt appear on his credit files? You can check Noddle Free Online.

Unsecured personal Loan.
We are going to check his credit file to see if this appears.

Were just looking at his file just now but I'm a bit confused about MCOL because it is asking for a claim no: and defence pack password but I cant find this on the Summons
Not sure if I'm being stupid but we are in Scotland and I know with something the Law varies so not sure if this must the reason I don't have this information. Do you know if it's dealt with differently in Scotland?

Has the claim been issued by the Sheriff Court or Northampton County Court Business Centre?
The Limitation (Scotland) Act provides a 5 year Limitation Period not 6 as in England.

Hi Kaljo, I was in a similar situation as yourself just over a year ago. Nolan solicitors obviously must deal with most, if not all Cabot's business north of the border.

As mentioned, don't panic. I took my claim to court and Nolans left the court room with their tail well between their legs!

Cabots/Nolans are just trying to scare you so stay strong. With the help of my peeps on this wonder site they got me through my case and I won.

You are not likely to find Welcome finance on any credit reference agency report as they went into administration and stopped reporting to CRA's. You are however likely to find Cabot (or crapbot as we like to call them :tinysmile_twink_t2. You need to do a CCA request urgently and inform Nolans (in writing) that you intend to defend your case.

When and IF a CCA agreement is forthcoming then things will start to get a bit more interesting. Don't delay get typing ......

You may also like to add to Nolan's in writing that you strongly believe the account is Statute Barred - that will make them sit up and listen as they have to prove that it is not.
