      My first thoughts:

      The sanction should not be lifted and the claim should remain struck out because:-

      The claimant should have the documents it intends to rely on to hand before it issued the claim.

      With foresight and due care the claimants solicitors should be aware that such documents are
      most likely to be requested via CPR31.14 and in any case should be in possession of the documents
      prior to the claim.

      I note that the claimant intends to issue another claim if the application is denied so the documents
      are now more important.

        OK thanks, when you say documents you mean the evidence they have sent to the court? It's about 8 pages of bank statements leading up to the account being closed, no covering letters or anything else. Most of it just shows the interest being added each month as no wages were going in at that time.

          OK I think I am going to call lowell to see if they will come to a repayment agreement with me. As if I go to court I think it's likely I will end up with a ccj?
          Would you say it's the best thing to do now? Would it be preferable for them to make a direct agreement with me as opposed to going to court? Thanks

            I called lowell and I was told my account was frozen and they were unable to deal with me as it has been passed to bw legal and to contact them directly. Gave nw legal a call and explained that I basically wanted to make some sort of repayment arrangement, the lady I spoke to was helpful however was unable to transfer me to the correct team (she said they were probably in a meeting) and that she would let them know I had called and someone would call me back later that evening. Still not heard anything and as the court hearing is the day after tomorrow I'm guessing I will have to go. So now I'm panicking a bit as I have no idea what to expect, and I'm literally going there empty handed.
            What is the best outcome I can hope for if I attend, and the worst if I don't?? Ultimately I would just like to make some sort of agreement with them where I can pay back a set amount each month and not damage my.credit.file any more than it is.
            Any help at this stage would be greatly appreciated!! Thanks in advance

              I would have thought that your best bet, given the very short time left, would be to ask for mediation.
              This should be available FOC at the County Court.
              Give the court a ring to make sure.
