    My feeling would be to reject the " agreement" as incomplete and therefore non compliant with the CCA request.

      How does it work with the response time of just over 9 months. i thought information had to be received by me within 14 days. Also would this not be statute barred anyway as the last payment was made January 2010.

        As to statute barred status the last payment date scenario has been somewhat overtaken by debt purchasers claiming the default date commences the 6 year limitation period..

        You need to be sure that no payments or written acknowledgments have been made in 6 clear years.

        The 12 + 2 working days to comply with a CCA request non compliance renders the debt unenforceable only Until the agreement or a complaint reconstituted one is supplied.

          As the claim was issued in Dec 15 , would the fact that a payment was attempted and returned in Jan 2010 scupper the Statute Barred claim?

          Was a defence ever lodged?

          I dont know but if not could they just apply to lift the obvious stay and get a default judgement?
