    Re: Court Claim - Hillesden Securities Ltd / Black Horse - 14-12-2015

    [QUOTE=Joany1212;609541]Hi Nem,
    I've received a letter from Mortimer Clarke saying basically that they believe I have already inspected the docs as I would have had them sent previously by the original creditor & are asking me to confirm what docs I have.
    Do I need to reply to them now as I've already submitted my defence?
    This type of letter is just a template for " please tell what docs you hold because we can't get any".

    So:

    Dear Mortimer Clarke.

    Ref: CC Claim No....................................
    My CPR 31 14 Request dated........................

    I refer to your letter dated.......................... in reference to my request made under the provisions
    of Civil Procedure Rule 31.14.

    Please note: What documents I may or may not have under my control is of no relevance to my
    request.

    Should any such documents exist they will be disclosed and when required within the progress
    of the claim.

    I remind you that the COR 31. 14 applies to a small claim until it is actually allocated to the track.

    Please forward the documents within 7 days from the date hereon.

    Non compliance will be brought to the attention of the court.

    Use signed for post.
