    I have checked my bank account and could not find any payments around the default date in that year, if anything it would of been the end of 2010 but im not sure....

        Thanks, Also I've phoned both Hillesden and Mortimer without giving any details just to ask what time they close tomorrow. I know one closes at 2:30pm and one at 2pm tomorrow, so I'm guessing if I need to send stuff off to both of them I have to get signed for 1pm so I have proof of deliver tomorrow ( I'm not sure how all this works when everyone is off for Christmas)

          OK.

          Claim acknowledged / good.

          Things to do.


          1. A CCA request to Hillesden for a copy of the agreement relevant to the alleged debt + a current statement of the account.
          There is a £1 statutory fee to pay, use a Postal Order endorsed " For Statutory Fee Only" the claimant has 12 + 2 Working Days
          to comply. Make sure this is addressed to Hillesden Securities Ltd. / Trading as DLC, there is evidence coming up that some items
          are being " misdirected " within the group of companies leading to requests being returned.


          2. A request made under the Provisions of Civil Procedure Rule 31 . 14 ( no fee) this is for copies of the documents mentione
          In the Statement of Claim Only. This goes to the solicitors. In this claim only the " Agreement & Notice of Assignment " can be
          requested.

          You will find templates for both requests in the forum library for both requests. Use signed for post.

          Any more details on the history/conduct and /or disputes on the account would assist in getting the best advice for you.

            I have never had any contact with any of them, and also I'm not really sure why the default date is 2012 when I'm sure the last payment if any would of been end of 2010 when I was dumb enough to use one of those debt consolidation companies ? anyway I did check and there was no payments from my account in that year, I'm not really sure what other information I can give to help

              When did the debt consolidation start? Were any payment made via this?
              There's a possibility that BH did not default when it first could do so.
              It's a pity we are so close to the holidays as I would suggest ringing BH
              and asking for details on the default date, which should be soon after
              a Demand for Immediate Repayment in Full and/or a Final Demand was
              issued.

                I think in 2010 but I didn't use them for that long as I realised how much they were ripping me off!!! other default dates on other things I MAY or MAY not have..... are around Aug / Sep 2010 so it would of been with all that I'm sure

                  Ill get these two letters off for 1pm signed for tomorrow, and later tonight ill go through my historic transactions online and find out the first and last payment if any for black horse and the debt company if that will help?

                    Little to do at this stage once the 2 requests have been sent.
                    Those dates make me think the account was defaulted late, was the credit file entry ever
                    marked with " Arrangement To Pay " (AP) markers.
                    At the point in time that all this was happening the Information Commissioners Office
                    Guidance on Defaults was that a default should be placed within 6 months of the cause of action.

                    Do you recall getting a Final Demand for Payment.

                      The last payment date to this debt would help, whether it is to Black horse or any debt collector doesn't matter. But it sounds as though this was not before 2010 - in which case this debt is not statute barred so you can't defend the claim on that basis.

                      The default date on your credit files is comparatively unimportant at the moment as it won't help to defend this claim. If you successfully defend and so don't get a CCJ, at that point you can try to clean up your credit file, but now that isn't a priority.

                      You haven't said anything that suggests there is a reason why you dispute the debt, either whether you owe it at all or whether the amount is correct. If there is any reason why you do dispute you owe this money, now is the time to say...

                      You mention other debts. Have they all gone quiet? What is the total owing? What is your current financial situation? Do you have any priority debts - mortgage/rent areas, council tax, utilities, court fines?

                        Its about 7 grand in total, and ive not heard anything from them in awhile, Rent is in areas a little and so is council tax, Im a novice to all this claim, If the debt is not Statue barred is it worth sending those letters as reading your post [MENTION=48934]Debt Camel[/MENTION] i dont have any grounds to defend ? hmm sorry really confused

                            Yes most certainly send those letters don't be disheartened by " negatives" I'm dealing with quite a number of BH hire purchase contract claims at present most have been SB at least 2 have no paperwork at all, and some have major faults like illegible paper work.

                            That's why we need to see what the claimant has in the way of documents, Hillesden has always been sloppy
                            with paperwork itself.

                              Thanks Nem i have a screenshot of all the info on this paticular claim from my credit file, it doesnt really go back any further than this so i dont see any AP on there
