        I have just spoken to a really helpful lady this time and she has informed me nothing has been filed with the court, so I guess I just wait and turn up in court on my hearing date!

            I was not told the claim was stayed, she informed me the court fees had been payed but nothing had been filed. Where does this leave me? Do I just turn up in court?

                  My guess is that Lowell's in house solicitors inexperience if they have nothing to back up their claim they may well lose the hearing fee.
                  Another new trick it seems to prevent the claim being stayed.

                      Just need some advice as my court hearing is on Tuesday Lowell have not filed anything with the court.
                      I have not been to court before do not know what to expect.

                        Have you checked with the court on the status of the claim?

                        If Lowell has not responded to a defence then the claim should have been stayed, so check tomorrow am.

                        This type of case is dealt with by a judge sitting in chambers not in an open court, the only people present will be you, the claimants representative ( if they turn up) and the District Judge or a deputy.

                        You need t have copies of everything relating to the claim that You have filed with the court.

                          i have just spoken to the court and they have informed me that they have received nothing from Lowell so I presume I should use this to my advantage.

                            Make sure you are at the court early they may leave it to the last minute to ask for more time. if they do this ( it has happened since Lowell " solicitors" took on claims Carter had buggered up.

                            If this happens protest the granting of any further time stating that the claimant has had more than enough time to produce the documents required and ask the judge to strike out the claim.

                            You can if this does happen you can ask the judge for costs if you have had any.

                              Yes hearing is tomorrow 2pm. The lady I spoke to said they have had no communication with Lowell since they paid the court fee in December but stated they might turn up tomorrow with any evidence they may have and suggested I speak to them beforehand to see what they have. She also stated that I should inform the judge as soon as I get there that no paperwork has been sent to me or the court. Anything else you think I should add, all help greatly recieved!

                                Yes that's good advice from the court, so as said above get there early.
