    Hi there,


    I have been away visiting my sister for the last 14 days and have also been very ill for most of October, so unfortunately I haven't been able to pay a lot of attention to any incoming post. In any to give you my brief backstory, I suffer from a number of chronic physical illnesses & also mental health issues. These illnesses and conditions make it nigh on impossible for me to deal with / and cope with financial matters / debt matters & issues. My mental health issues include severe anxiety, moderate to severe depression, & I have also in the last year been diagnosed with a Borderline Personality Disorder.


    On the 2nd November 2015, I opened a letter from Restons Solicitors, dated the 6th October 2015, which explained the following:


    "Our Client: Arrow Global Limited
    Current Balance: £1,105.27


    We act on behalf of Arrow Global Limited who has instructed us to write to you concerning an outstanding debt due to them. Our client has obtained a County Court Judgement against you. The balance outstanding to our client under the Judgement is £1,105.27. When a Judgement is obtained against an individual, that individual's credit rating is adversely affected. Credit reference agencies hold details of Judgements entered against you; creditors look at this information when deciding whether to lend money to you. Although our client wants to make every effort to agree an affordable repayment arrangement with you, please note in the event payment is not made, our client has the option to pursue enforcement action.


    Where we have information that suggests you are employed we may be instructed to apply for an Attachment Of Earnings Order. A fee will be added to the outstanding balance and your employer may be ordered by the court to deduct payments from your salary until the Judgement balance is repaid.


    We may be instructed to issue a Warrant of Control. This enables a County Court bailiff to attend your address and levy on goods to the value of the Warrant. A Court fee and costs will be added to the Judgement balance.


    Where we have information that suggests that you are a homeowner, our client may also consider securing its position bu obtaining a charge on your property.


    Our client would prefer to reach an affordable repayment arrangement with you to avoid further legal action. Please contact us as soon as possible to discuss the various repayment options available. To help us understand your overall financial position and to determine how much you are able to afford, we also enclose an Income & Expenditure form for you to complete and return to this office. We would like to work with you to establish how you can repay this debt. Alternatively, you can also seek free independent financial advice from one of the organisations detailed on the reverse of this letter. It is extremely important that you contact us to discuss your situation. We can only assist you in resolving this matter if you get in touch. A settlement may also be available, subject to affordability. Please contact us on 01925 661699 or write to us at the address detailed above".


    I have no idea as to when this letter arrived. But, however, one thing I am very sure of is that I haven't a clue as to what or whom this debt relates to!?! Therefore on reading this letter I was quite shocked to say the least, followed by feeling very angry and frustrated that obscure companies whom I do not have a clue about, are just coming out of the woodwork claiming that I owe £X to X, Y, & Z! As you will appreciate it is not helping my state of mental health at all, and my anxiety is already heightened because of the nature of the threats contained within the letter from Restons Solicitors. :-( By the way, this is the first such communication I have received from this firm of Solicitors!


    I picked this letter up just before I went away to visit my sister, but, unfortunately, I didn't have the time to deal with it nor did I feel well enough. This was on the 17th October 2015, and I returned home on the 1st November 2015. I barely had time for my feet to touch the ground, and I bravely opened a letter the following day on the 2nd November and it was 'Notice of Application for Attachment of Earnings Order' form from my local County Court in Blackwood! :'( As you can imagine by now my anxiety was through the roof, and I was just shell-shocked!


    Not only haven't I had time to digest and process whom the creditor is, and I still do not have a clue who the claimant is (Arrow Global Limited), but the amount alluded to doesn't ring any bells either! Therefore I do not even have ANY knowledge of this debt, or acknowledge it... let alone plan to pay it!


    Also, as I understand, sending a 'Notice of Application for Attachment of Earnings Order' is for an employer to deduct so much money from salary / wage before an employee is paid! Obviously they have their information incorrect as I do NOT work, I am registered disabled and receive disability benefits ONLY!


    More to the point, as I am currently still dealing with another Claimant who had intended to issue a CCJ against me, but which is now currently 'stayed', I haven't at any point received any Court / legal documentation to serve Notice on me that Arrow Global Limited / Restons Solicitors intended to issue a CCJ against me! Therefore, this denied me the right to be able to 'defend' myself against the aforementioned Claim! All that has been mentioned is a paragraph in the Restons Solicitors letter to state that their Client had already obtained a CCJ against me (letter dated the 6th October 15).


    The date on the 'Notice of Application for Attachment of Earnings Order' is the 27th October 2015, and the Court has given me 8 days in which to reply, which I make today! It states that failure to return the form will result in my employer being contacted, and that I may be sent to prison for up to 14 days - as it is a punishable offence evidently in failing to complete and return the form. I simply haven't had the opportunity or the time in which to complete the form, and now my anxiety is at an all time high!


    I would be extremely grateful for your help and assistance with this, as I am angry, upset and also worried too.

    you must fill in the form and tell them what benefits you receive and your outgoings if you ar not employed no AOE

    Wait for more help on here how to deal with this and other debts above al don't worry they cannot do that much only try to get some money you will only be paying what you can afford

      Arrow Global is a Debt Purchase company.
      Tom I know this is hard for you and very difficult to deal with but I need to ask some questions.

      Have you found amongst your post over the last 8 weeks or so an envelope with HMCTS on the top?
      This is a claim pack from the Northampton County Court Business Centre.

      I think the best way of dealing with this is to write to the solicitors explaining the situation regarding
      your health and financial situation.

      I can help with a letter for this if you wish

        Hi Nem,

        I once again apologise for only now getting back to you. I have had a horrendous day as because of this chest infection I had to visit the doctor on an emergency appointment; I have been struggling to breathe since the early hours (Thursday morning) and it turns out that I had suffered an asthma attack.

        Anyway, that's my medical update (sorry for that.. lol), it's just not my week this week. I have none the less calmed down now and realised that it's no use in becoming angry over this as it won't get anything resolved - but I am becoming frustrated that out of the blue these 'creditors' just seem to appear.. and I am starting to feel somewhat overwhelmed! I have racked my brain and I still do not have a clue what this alleged debt is about.

        In answer to your question, no I can safely say that I do not recall receiving anything from the HMCTS (Northampton County Court Business Centre) within the last 8 weeks. I am well versed in looking out for 'formal' type mail, and would recognise court papers, DWP letters, HMRC correspondence, etc. I picked up immediately on the previous CCJ application for Lowell, so suffice to say I would have been the same with such correspondence relating to Arrow Global Ltd / Restons Solicitors. I have also double- checked past mail too, but there isn't anything.

        I am truly grateful for your offer of help in writing a letter to the solicitors, and I gladly accept it, as I wouldn't even know where to start! :-)

        There is one matter that is worrying me greatly though, which is the 'Attached Earnings Order form' that I received from the local County Court. It needed to be returned yesterday (Weds 4th November 15), as I didn't realise that there is only an 8-day turnaround to complete and return the aforementioned form (dated the 27th October 15). However, obviously if I had completed and returned this form effectively I would have been acknowledging and accepting the debt - as I understand? The part that worries me the most is the bold text that states that if the AEO form isn't returned by the deadline date this is a punishable offence, and I could face up to 14 DAYS IN PRISON! I would be grateful if you could clarify this one matter as soon as possible, as it's been playing on my mind quite a bit all week, and is worrying me sick! Obviously as you can see it has been a fraught and frenetic week in any case, and I had very little time left in which to respond to the AEO court order - and this is without taking into account my mental health issues, which makes things more difficult to process, about ten-fold, in my case! :-/

          Sorry to hear you've been unwell!
          Your are doing the right thing don't let this affect your health any further!
          The AOE is dead in the water in your case, so just return it to the court with a covering letter stating you are not employed.
          I have to be out for a couple of hours this morning. I'll get to the letter after that.

                Many thanks for the letter, this is great and puts things together that I would probably take about 3 pages to explain. I really appreciate the time and effort you've taken in writing it, and I don't think there is much more for me to add to it. I did, of course, make quite a few copies of the GP Medical Letter, which I previously sent to B C Solicitors Ltd, so if necessary I will send this to Restons Solicitors as evidence of my Mental Health issues if requested by them.

                I am trying to rise above these matters and to not allow them to detrimentally affect my health, as I already have enough going on in my life as it is. But my thought is that Restons really won't get much out of me as I do not have much in the way of disposable income anyway, so try as they might... I will just (as my daughter often says) put my 'la la' fingers in my ears! lol

                I will endeavour to post this letter (by 1st class recorded delivery), as well as the AOE form (to the Court), this afternoon so at least this is one less worry for now. I will, of course, keep you posted on matters.

                Once again I am truly grateful for your help and assistance.

                    Hi there, I received a reply from Restons Solicitors Ltd today, coincidentally at the same time as a reply from the local County Court too. :-/ Here is the letter, as follow (from Restons):

                    "We write further to your letter dated 6 November 2015.

                    For your information this account relates to an Egg Loan, original account number **********, which was opened 6 February 2003. A County Court Judgement, case reference A9XF8755, was entered on 16 October 2014.

                    We have noted the health issues you have brought to our attention. Our Client takes health matters very seriously and would request supporting documentation in relation to your ill health by no later than 27 November 2015 to allow us to consider your circumstances fully. Supporting documents need to be in form of a letter from either your GP or specialist consultant. Unfortunately, copies of prescriptions or appointment letters will not be accepted.

                    We have written to the Court and requested they adjourn the Attachment of Earnings application with the liberty to restore temporarily until the above documents have been received.

                    We also note you have a third party assisting you in this matter. Should you wish us to liaise with a third party on your behalf directly, please reply to our office by the above date with their name and address".


                    Needless to say I am fine liaising with this company, so I wouldn't put you in the position of the 'third party'. ;-) And I am fine with providing the requested medical evidence, as I have a GP 'Medical Letter' from the last time I needed to provide Bryan Carter Solicitors with medical evidence. And I received the Court letter, which corroborates the last but one statement in the letter.. although I am not entirely sure what is meant by "liberty to restore temporarily"?

                    I vaguely remember having an Egg Loan, and being in an agreement with another debt collection company (I can't remember their name right now) quite some time ago (about 5 to 6 years ago) to repay off about £2 per month (with interest frozen), due to my financial circumstances. But, for some reason the payments from my account disappeared without any explanation so I had assumed the loan had either been paid off, or the debt would be picked again, i.e. that I would receive a letter asking me to setup another D/D. However, this was 2 years ago and there wasn't anything forthcoming so I naturally I assumed the Egg Loan had been 'settled' per se, but obviously I was wrong as I've discovered recently. More to the point I would have clearly remember receiving paperwork for a CCJ last October (and I had to read it twice to check the year), as anything formal I don't let slip through the net.. despite my anxiety. It strikes me as bizarre as to why now this firm of solicitors Restons are suddently getting heavy-handed!

                    So, the position I am in is that I recognise the 'debt' but I do not acknowledge it, as it was my understanding that it was paid off as collection activity had ceased and no further communication received! Believe you me, this debt is one part of my matrimonial debt.. and part of history I would much prefer to forget! lol But, if only it were that easy! :-( So I am in a quandry now as to what to do for the best here, as obviously if I do not send 'proof of my illness' to them they intend to re-instigate the AOE order again.. which I find a bit perplexing!?! But if I do send it, then obviously I am admitting to the whole sum of money allegedly owing, which I know isn't the case (again)! And I never had the chance to defend this claim in the first place, which is the most infuriating thing!

                      Anything you do send should be stated to be " provided without any admission of liability"!
                      and/ or " this information is provided as a gesture of goodwill and without any admission of liability.

                        My apologies for the prolonged absence from the forum. Unfortunately, I have been unwell for some time and have been suffering from a chronic & severe depressive episode, so I have been offline for quite some time. :-/ It couldn't have happened at a worse time, i.e. over Christmas, which only exacerbated matters, but I made the best of a bad situation. However, I hope you had a lovely Christmas.

                        Anyway, during this time I finally received a reply from Restons Solicitors, and by way of a letter through the post only 2 days before Christmas... impeccable timing (in reply to my correspondence of the 16/11/15!). As follows is their reply:

                        "Dear Sir

                        Re: Arrow Global Limited v. Yourself
                        Arrow Global Collections

                        We acknowledge receipt of your correspondence dated 16 November 2015.

                        As the County Court Judgement was entered prior to our office becoming instructed, we cannot comment on the nature of the proceedings issued. As Judgement has been entered against you, your liability has been determined and we require proposals for repayment via the attached financial statement by 11 January 2016.

                        Should you need to seek your own independent advice, please find the details for some money advice groups below:

                        So it seems Restons Solicitors are now distancing themselves from the County Court Judgement, against me, following my previous letter. This seems to be a change of tact by them and, even if true that the Judgement was entered before they took on responsibility in chasing this alleged debt owed by me to Arrow Global Collections, they were quite insistent the last time they contacted me that I honoured the terms of the Attachment Of Earnings form. Obviously now that I have pointed out the fact that I do not actually work, and that my only income is derived from benefits, they no longer wish to discuss the details of the CCJ or why I wasn't given a chance to defend myself against the AOE! Apparently their only concern now is that the Judgement is in place and that I am STILL liable for this alleged debt! Hence, they want ME to now complete a financial statement, and to propose a repayment with THEM!

                        So it appears I am no further forward, as how can I complete a financial statement and then agree to a repayment proposal, based on a County Court Judgement I have no knowledge of, AND for an alleged debt that I do not even acknowledge? I would be very grateful for any help and / or advice on this, please.

                          I agree it is impossible to respond in the way they want.

                          I do not understand Restons stance you have no income other than benefits and no realisable assets what the
                          hell to they want you to do.

                          I think we should cut Restons out of the matter there approach seems to one of self interest i.e. fees and commission.

                          I will if you wish compose a draft letter to AG Restons make me furious with their banal letters.
                          I cannot see how they don't see a vulnerable person difficulties.

                            Many thanks for replying so quickly, I really appreciate it. :-) And many thanks too for asking about my health & well-being. My depressive episode couldn't have come at worse time, coinciding with the Christmas period, and, unfortunately, I allowed a few things to get on top of me. I feel a lot better compared to about 2 weeks ago and am managing to cope with things better, so I am slowly catching up with things at the moment. I should be okay with dealing with this matter.

                            It seems like Restons are clutching at straws, although it is difficult to second guess them as their letter somewhat perplexed me to be fair. I couldn't have made it any clearer the last time I wrote to them about my financial and health situation, so they are well aware that I receive benefits only as my income... and that I am classed as a vulnerable person according to my GP. But I hasten to add I am not willing to pay another £25.00 to my GP to obtain proof of this, to send to them as they have already been sent one GP letter (previously) which clearly states that I am in no fit mental state to be able to cope with financial or debt matters! So, I am quite angry that they have come back with this letter more or less now demanding financial information from me... and then demanding a repayment plan be set up! All the while they are well aware that I do NOT acknowledge the debt as I wrote this quite clearly on all of my previous correspondence to them! It seems to be that they're acting very immorally at the very least and have totally disregarded everything that I have explained to them / sent them (including the GP's letter).

                            That would be great if you could compose a draft letter for me, and I would be most grateful for this. :-)
