  • What should i expect / prepare

    Hi All.

    Could anyone offer any advice on what to prepare ahead of a hearing to have a Judgement set aside (I am the defendant) and also what to expect on the day?

    Hi,
    You need to gather your data regarding the reasons the court should
    order the judgement to be set aside. a bullet pointed list is helpful with
    this.

    You will also have to show that you have a defence to the original claim,
    that has a reasonable chance of success.

    Is the application contested by the claimant?

      Hi Nemesis,

      I have a proposed defence for the original claim that I have now been sent a copy of, will I have to talk though this at the hearing?

      I'm not sure if the application has been contested? would this be something the court can tell me?

        Did you inform the claimant that you were applying to have the judgement set aside?

          We have had no direct contact at all. She has been made aware via the court as the hearing date has been scheduled
