    Hi yes sorry I didn't know how to make a new thread, yes my original claim was stayed, I now have two claims one being Capquest/Drydens for Shop Direct and along with that have another one which is Capquest/Restons also for Shop Direct. Sorry

        The two claims may be similar but they will travel through court proceedings at a different speed depending on what is or isn't produced by the Claimant since they were issued on different dates. The court filing deadlines will be different too.

        One may become stayed while they hunt for the documents, while the other may go full steam ahead regardless hoping they'll find what they need by the WS stage weeks/months later.

        I suppose that will depend on the fact that the two solicitors are like chalk and cheese when it comes to litigation. One is actively aggressive while the other can be more 'gentle' in their approach.

        I'm surprised Capquest didn't instruct one firm to deal with both claims since the original creditor is the same so they could have considered issuing one claim for both debts to save court time and costs.

          Hi, so far I have just received a letter from Capquest saying they have forwarded my request for the CCA for Shop Direct. nothing from solicitors yet but I'm worried about when I have to file my defence as my acknowledgement of service was 26/04/17 would you be able to tell me around what date I have to file my defence as I am really unsure.

            What is the issue date on the Capquest court claim form?
            If you add 33 days to that, it will give you the deadline for filing your defence.

                  Hi the date on the claim form is April 26th and I still haven't had any response from my CCA and SAR, do those include weekend days? should I start to file my defence now?

                          is there a template that I could copy and try and do from my phone at all for not receiving the SAR or cca in time maybe I could try get my partner to do it for me at home

                                all done now thank you, I spoke to the court this morning and they have said that the solicitors now have 33 days from the 30th May to respond and see if they take it further or leave it but my question is asbthey have not produced anything that I have asked of them could they still take it further?
