    Who is Mortimer Clarke Instructed by? (who is their client).

    Can you post up a suitably redacted copy of the N1 Claim Form please?

      they are instructed by cabot financial, for a credit card that was originally issued by vanquis bank,
      amount claimed £415 Court Cost £50 Court Cost £50 = £515
      court claim issue date 2nd oct 15 and i cant upload a picture at the time being, currently at work and this is quite sensitive.

      i believe i have 8 days to respond.

        Hello Craig,
        You need to acknowledge service of the claim asap you can do this online at money claim online MCOL make sure you make careful note of all the details especially the password.
        Just acknowledge and state intention to defend in full at this stage.

        Things to do:

        A request under the provisions of Civil Procedure Rule 31.14 (CPR) this goes to the solicitors to
        request copies of all the documents mentioned in the Particulars of the Claim Only! The is a templatin the
        forum library for this. ( there is no fee for this request)

        Next a request made under the provisions of sect. 77/78 Of The Consumer Credit Act 1974 ( CCA Request) this for a copy of the agreement relating to the claim. This goes direct to Cabot at the address on the claim form.
        There is a £1 statutory fee to pay for this, use a cheque or postal order endorsed " For Statutory Fee Only", Cabot has 12 +2 Working Days to comply. Use signed for post and check delivery date the timescale starts then.

        Then can you give us some history of the debt please.?

        When was the account opened?
        When was it defaulted?
        The date when the last payment or written acknowledgment was made in relation to the account?
