  • Attachment of Earning

I have received a Notice of Application for Attachment of Earning order from Reston Solicitors (for cabot).
Back in July 2015 I received County Court Claim and settled for a payment of £125 per month to Cabot.
Unfortunately no other correspondence came through the post so I wrote to Cabot in August asking them to give me the details for me to make payment enclosing the General Form of Judgement order.
Now the Attachment of Earning order has come through the post to return to Basildon Combined Court. Please help how to deal with this. May be I should have sent my letter to Reston Solicitors

    Many thanks

AoE orders are a common way of enforcing CCJs when no payments are being made and the debtor is in employment. You just need to fill in and return the form. If you go down to item 10 on the N56, you'll see you can tick a box to request a suspended order and a space to give your reasons for requesting a suspended order. The most common reason is that an AoE could affect your employment and you'd rather make payments yourself. Make your repayment offer in the box and provide your financial details as requested to back up your offer.

Most requests for a suspended order are granted because creditors wouldn't want people to lose their jobs which would mean being unable to pay back their debts. :thumb:

Many thanks, what about the fact that I actually wrote to Cabot in August asking them for the payment details, is this no a valid request not to pursue this any further. They never responded. I am not trying to avoid paying but I just do not have any reference or account details to make payment.

You should keep all the posts on one thread otherwise people can't see the full picture.
