Letter from Shoosmith Solicitors/cabot financial threatening court

    Hello everyone, i hope you are all well!

    a little update:

    I received a letter from shoosmith yesterday dated "3/12/2015" with no relevance to my previous letters about the cca request etc. It simply states

    "We kindly advise that it is our clients instruction to reach a formal arrangement for the repayment of the outstanding balance. Our client has confirmed that it is is willing to consider an offer of repayment in accordance with your circumstances."

    It goes on asking me to complete a income and outgoings form to arrange a payment plan. I also received a letter from Cabot last week but it was just a annual review of my account with them stating i hadn't paid them a penny.

    Neither of them say anything regarding our previous letters back and forth? They seem to have simply ignored them?

    What would you guys suggest here?

      Sounds like they cannot find the agreement! Interesting to see what the clever beagles have to say

                Hello everyone, had some 'bad post' this morning after i thought all this shoosmith stuff had calmed down. I received a "Claim form" from the county courts?

                It says i have 14 days to respond. Could someone please help on what to do from here? I sent the CCA request a while back and never received my agreement etc and now a CCJ in me letter box. My partner and i are really really worried now we won't get rid of this people! please help!

                          Things to do:

                          1. Acknowledge service of the claim online at MCOL. State Intention to Defend in Full.
                          do not mention anything in defence at this stage.

                          2. A CCA request to Cabot UK Ltd ( at the address on the N1 claim form)
                          £1 statutory fee payable: Use a Postal Order made out to Cabot UK Ltd. Endorsed "for statutory fee only".
                          Cabot has 12 +2 Working Days to comply) ( Forget all previous requests for now!)

                          2. A request made under the provisions of Civil Procedure Rule 31 .14. This is for the documents mentioned
                          in the statement of claim Only. i.e. The Agreement, The Notice of Assignment, and The Default Notice.
                          There is no fee for this request. This must be sent to Shoosmiths by signed for post .

                          Use the templates from the forum library for both requests, Check the dates they are delivered.

                          Please don't stress over this Cabot has now got to put it's proof up for examination no wasting time.

                          You will get help and guidance through the court process here.

On the cca request to cabot, for the ref number do i put my account ref with cabot like my old cca request or put the new claim no i got on this letter from the courts? and secondly, would you mind possibly linking me to the

                              in the statement of claim Only. i.e. The Agreement, The Notice of Assignment, and The Default Notice.
                              There is no fee for this request. This must be sent to Shoosmiths by signed for post ."

                                2. CPR 31.14 template is in the forum library.

                                This is a formal request made under Civil Procedure Rule 31.14 :

                                I request the following documents mentioned in the Particulars of Claim No............................:
