Hi, this is my first post so apologies if it is in the wrong area. But I hope someone can help.
We have a claim against a pub for a unpaid invoice of around £1400 which the HM Courts and Tribunals Service issued a warrant for. The baliffs have repeatably visited the public house in question but as it opens late they have found it difficult to execute the warrant apparently. The owner/landlord mentioned to them the company has changed hands since the debt, which we know is not true and they have not supplied any evidence to proof this, despite being asked numerous times. I believe this is just delaying tactics. The baliffs have now come back and said that as the warrant is in the name of the pub not the name of the owner (person or company) they can not execute the warrant.
I feel that the baliffs are not really putting in much effort and this is just a excuse so they do not have to visit the premises out of the normal hours they work.
So I have the name of the pub on the warrant and not the company name behind the pub. So my question is :Surely the name of the pub is the 'trading name' of the company in question so should still stand?
Any advice on this would be gratefully received.
