    the claim for £1823.72 the amount due under the agreement between the oridgenal crediter and the defendant to provede finance and /or services and / or goods this debt was assigned to /purchased by lowell portfoilo on the 13-3-2015 and noticed servied pusuant to the law of proerty act 1925 particulers re -jd williams a/c XXXXXXX and the claiment claims 1823.72 the claiment also claims statutary interest pursuant to s69 of the country act 1984 at a rate of 8% per annum from the date of the agreeenamt to date but limited to a maximem of 1one year and a maximumof 1000 to 68.75

    my wife had a stroke and i am her full time carer when this debt first apperded i ask jd William could i make a redused pa ment of 10 a mounh but they said rejected this amount saying it had to be 65 amount which was impossible to pay because living on dla and income support benifit s and got very rude with me on the phone

                      It is a typical response from Mr Carter, and this is our typical response: http://www.legalbeagles.info/forums/...385#post410385

                      He never sends any documents or agrees to an extension :rant: :rant: :rant: but you still need to follow the process so when it comes to filing your defence, you can show at least one party did follow the appropriate procedure.

                      I also noted the CCA mentioned, there is no need to chase Lowell for that one, as non-compliance with a CCA request is a bar to enforcement and will be mentioned in the defence. :thumb: :grin:

                          You'd have to send the letter linked to above as part of the process, then just keep an eye on the calendar so you file your generic defence before the deadline (33 days from date printed on claim). :thumb:

                            [MENTION=71504]patman1234[/MENTION] ... as FP says, your defence will be due in 33 days after the date of issue on your claim form. Date of Issue was the 2nd September, so it needs to be in on the 5th October (http://www.timeanddate.com/date/date...aw=&ad=33&rec=). Don't worry, you'll get lots of help with it :nod: xx
