  • Claimant assigns account part way through court proceedings

    Is it possible for a claimant to continue proceedings against a debtor in his own name if he (the creditor) assigns the account part way through the proceedings. I imagine the claim would not be allowed to proceed as the original claimant no longer owns he debt.

    I realise that the party to whom the account is assigned would be able to commence proceedings in his own right.

      CYN,
      Pt has made this clear on one of the threads............I would check his latest posts .......his view is ...........They cannot continue and the Court should be asked to strike out the claim..........and resubmit the claim in the name of the new Claimant..........and the Defendant should ask for their costs.
