  • Judical review dwp

    Hello,

I was wondering if anyone knows of any solicitors that would assist me against the dwp.
I am no longer in receipt of benefits but the DWP stopped my benefits for over two years over false allegations
In October 2011 my income support was ceased illegally and I was put by the DWP in a crisis situation where I was unable to wash, feed and heat my children and myself adequately for nearly two years. The department of work and pensions tried to prosecute myself for benefit fraud of which I was found Not Guilty.
If the department of Work and Pensions had not illegally forced me into a crisis situation I would have not needed any crisis loans.
My Daughter who was born in March 2011 and has suffered long term ill health issues due to the DWP illegally stopping my benefits as I was unable to heat my house adequately, she has had persistent colds and ear infections and has glue ear (that can be proven by medical records) and now has severe speech delay because she has been unable to hear until recently when she has had grommets fitted.
The Department of Work and Pensions has severely violated mine and my children’s Human rights and have gone against there own code of conduct. (Stopping a vulnerable person benefits)
The pain, suffering and severe hardship they have caused me and my children is incomprehensible. I nearly lost mine and my children’s home as I was unable to pay my mortgage, I had to go to friends houses to just wash my children, I got credit from high interest loans, borrowed and begged just to be able to put food on the table. I was deprived of my dignity to the highest degree. My mental health deteriorated to such a state where it can only be described as extremely poor and it was numbingly painful for my children and family members to have witnessed this.
At the moment I am unable to progress further in my current situation as a stain on my credit file will stay with me for six years. I am now unable to get any sort of credit due to not being able to pay back high interest loans and my mortgage on time during the time I was victimized.
The Department of Work and Pensions put me in a crisis situation where I had no choice but to take out loans that you were aware I was unable to pay back.

Within a few months of my benefits being reinstated and receiving back payments (of which i had to go to a tribunal to get) I decided with help from family members to cancel my claim as I did not wish to endure ever being in the situation again.
I believe I am entitled to financial compensation for violating mine and my children’s human rights and also the pain and suffering we have endured from my poor mental health, my children’s poor mental health, my daughters physical health, the extreme hardship that has been have upon us and the financial loss I have suffered.

i believe two years is an unreasonable amount of time to leave a vulnerable person with children without financial assistance.

I apologize for this post being so long but i have overwhelming evidence against the DWP and wish for justice to be done.

    Hi and welcome

Can you tell us what were the reasons why they DWP stopped your benefits when you had a six month old baby to look after?

If you ended up in financial hardship due to maladministration by the DWP you could make a claim for compensation ... they have a procedure in place to deal with issues like this (see attached).

Were you not able to claim hardship payments while under the sanction?
