    if you read similar threads you will see in a lot of cases they threaten up to the last few weeks or so then discontinue just in time to get a refund of their court fee if they as normal cannot get CCA1974 etc,

        It's a lovely day here.

        Once the questionnaires are returned the court will fix a date for the hearing and give directions to provide the documents at least 14 days prior to the hearing so there can be no surprises in court.

        If they can't get their dirty hands on the paperwork they may have to discontinue, ray: after all their efforts that would be a shame, wouldn't it? :lol:

            I have received a letter from Bryan Carter giving me a copy of the questionnaire Lowell filled in and also saying that the claimant is prepared to settle out of court and they look forward to hearing from me regarding negotiations.

            I am wondering whether to phone them and offer them some money or no money or do nothing. Also, I sent back my question air and signed it. Will they get a copy? I've read lots about Lowell and Bryan Carter forging signatures on credit agreements!

                Hi L,

                What are the details of the DQ?

                Never negotiate with Carter or Lowell by phone, calls are often curiously not recorded, of just denied later.

                Your should sen/serve a copy of your DQ to Carter and the court.

                  Thanks for your advice. Is the DQ the questionnaire they completed? If so, the details are exactly as I put on my questionnaire saying that I agree to track and to mediation. Also stating my local court for the hearing and I dates unavailable to attend court.

                  I didn't keep a copy of my questionnaire! Usually I do with these things, but I was in a hurry and just filled it in and posted it back to the court. That's it. Do I need to issue a copy to Bryan Carter?

                    Omg I just noticed that the letter does say I need to send copies to the claimant!!! I haven't and the questionnaire has been sent, I don't have another copy and it has to be served by 5th October!! Am I done for? Can I claim it got lost in the post?

                      So, after a crazy hour of dashing to work to print out and fill in another form downloaded from online, I made the post office! Bryan Carter won't have an exact copy, but will have a copy of the information I sent the court. Hope that's ok? Can't believe I didn't read the letter properly!

                        If they were so so sure of winning, why would they be sending these letters? In any case, you shouldn't phone them at all, all communications should be in writing, however, I'd be inclined to just file this one under "C". :ranger:

                        Although they like their dirty tricks, I think this is probably a bit of an urban myth, going to court with a forged signature would be a serious criminal offence and neither Lowell nor Carter would want to risk their futures by doing something as obvious and silly as that when the Carey case has established that a signed agreement is not a requirement for compliance with s.78 of the CCA to start with.

                        Don't panic, you should be OK. Yes, the questionnaires should be served on the other party just like you got a copy of theirs but if it gets to them a day late it won't be the end of the world. :thumb:

                          If Carter or Lowell have been forging signature it would almost certainly been publicised and court action
                          and intervention by the regulatory authorities would have ensued very quickly.
                          Did you not keep a copy of the DQ for yourself?
                          You will need to copy everything that you have to complete and return to the court and
                          or Carter.
                          Phone the court speak to a manager and they may ( only may) be willing to send you a copy
                          and one to Carter.
                          3 copies of every thing at least 1 for court. 1 for solicitors & 1 for your files. A couple extra often useful as documents
                          can and do go astray.

                              You will soon hear from the mediation service asking you whether you've got enough information, and I think I can guess what the answer will be. The idea is that they are relying on the original creditor to supply the documents so they are just buying time and hoping they can get their hands on them. Unless they can whip something up by the time you hear from the mediation team :flypig: :flypig: they matter will proceed to court and a hearing will be scheduled. They will be required to send you the paperwork at least 14 days prior to the hearing date, if they can't you could well be looking at a Merry Xmas! :cancan:
